Notices of Action
Welcome to the Leon County Clerk and Comptroller's Office Notices of Action page.
Notices of action are used to obtain constructive service (also called service by publication). Constructive service may be used if a party does not know where the other party lives or if the other party lives
outside Florida and personal service cannot be obtained. Constructive service allows the court to grant certain requests but personal service is required for some issues.
As required by Florida Statute 49.11, "Copies of the notice shall be posted at least 28 days before the return day thereof in three different and conspicuous places in such county, one of which shall be at the front door of the courthouse in said county. Proof of posting shall be by affidavit of the person posting the notices, which affidavit shall include a copy of the notice posted and the date and places of its posting". These notices will remain for the required 30 days and then will be removed.
